Attorney General Drew H. Wrigley has announced a settlement with Vando Holdings Corp., K & L Products, LLP, Kristen Doka, and Ryan Doka, operators of the Delta 8 Resellers website. The settlement is in response to allegations of illegal sales of vaping products to North Dakota residents, including minors.
Based in New Jersey, Delta 8 Resellers markets and distributes a variety of hemp, THC, Delta 8 THC, kratom, and mushroom products nationally. The investigation by the Consumer Protection and Antitrust Division began after reports of illegal sales of electronic smoking devices to a minor in North Dakota. The inquiry further uncovered sales of products that violate state laws, including providing controlled substances and misbranded products.
Despite denying any unlawful conduct, Delta 8 Resellers has agreed to an Assurance of Voluntary Compliance to resolve the claims. The terms include a one-year halt on sales to North Dakota residents. If the company resumes operations in the state, it must implement age-verification measures and comply with legal restrictions on product sales. Additionally, the company will pay a consumer refund and a $10,000 civil penalty, with $5,000 suspended upon compliance with the agreement.
Attorney General Wrigley stated, “The products sold by this company may be dangerous, and this settlement aims to stop this company from selling and shipping such products into our state that can harm North Dakotans.” Some products might contain controlled substances, and their labeling does not accurately reflect their contents.
Wrigley emphasized the importance of responsible sales practices, criticizing the company's former lack of “meaningful age verification before selling and shipping its products” as “unlawful, careless, and offensive.” Should the company wish to renew business activities in North Dakota, it must ensure the use of age-verification technology to prevent sales to individuals under 21.
