Attorney General Drew Wrigley has called on consumers to check if they can receive compensation for certain generic drug purchases. This follows a multistate pursuit, involving 50 states and territories, for a preliminary approval of a $39.1 million settlement with generic drug manufacturer Apotex. The case, filed in the U.S. District Court for the District of Connecticut in Hartford, centers on accusations of conspiracy to inflate drug prices and limit competition.
Last fall, a settlement with Apotex was announced by Attorney General Wrigley and the coalition along with a $10 million settlement with Heritage Pharmaceuticals. The settlement was initially contingent on signatures from all necessary states and territories, which have now been obtained.

The settlements aim to resolve allegations that Apotex and Heritage engaged in conspiracies to inflate and manipulate drug prices, reduce competition, and restrain trade for multiple generic prescription drugs. Both companies have agreed to cooperate in ongoing litigations against 30 corporate defendants and 25 individual executives and have committed to reforms ensuring compliance with antitrust laws.
Since 2016, North Dakota has been part of a coalition of nearly every state and territory filing antitrust complaints addressing various drugs and defendants. These complaints claim collusion and conspiracies that have led to illegal price increases and established a culture of collusion in the generic drug market.
“We are working hard to return money to North Dakota consumers who paid too much for their medications because of the collusion and conspiracies in some segments of the pharmaceutical industry,” Wrigley said. The Attorney General encourages North Dakotans to check their eligibility for compensation to assist in identifying those entitled to receive it.
