The U.S. Attorney's Office for the District of North Dakota has reached a settlement with Mandan Parks and Recreation concerning the Starion Sports Complex. The agreement addresses allegations that certain features of the complex violate the Americans with Disabilities Act (ADA) of 1990.
The Starion Sports Complex, which opened in 2017, is an 84,000 square foot facility featuring two ice rinks, a gymnastics center, and other sports facilities. Tenants include the University of Mary, Mandan School District, Mandan Hockey Club, and Dakota Star Gymnastics.
An ADA complaint alleged that the complex was not fully accessible to individuals with disabilities. The investigation found issues such as a lack of accessible paths to visitor seating at the football field and inadequate integrated seating in the competition ice rink. Other areas like toilet rooms and concourses also did not meet ADA standards.
Under federal law, public entities must ensure their services are accessible to individuals with disabilities. Newly constructed buildings must comply with ADA requirements.
U.S. Attorney Mac Schneider stated, "Protecting access for individuals with disabilities is a priority for the United States Attorney’s Office." He praised Mandan Parks and Recreation for its cooperation during the investigation and commitment to addressing violations swiftly.
Assistant United States Attorneys Melissa H. Burkland and Tara Vavrosky Iversen handled this matter along with Paralegal Specialist Michelle Erdmann.
The public can file complaints about accessibility issues online at www.ada.gov or contact the U.S. Attorney’s Office directly.
