Senate challenges Biden administration's 'Once-in-Always-In' rule through CRA resolution

Senator John Hoeven, a member of the Senate Energy and Natural Resources Committee, issued a statement following the Senate's approval of a Congressional Review Act (CRA) resolution. This resolution disapproves of the Biden administration’s "Once-in-Always-in" rule, which classifies specific industrial facilities permanently as major sources of hazardous air pollutants.

The rule in question reversed a previous policy by the Trump administration. Under the old rule, facilities could reclassify and lower their compliance costs if they reduced emissions below federal thresholds.

Representative Julie Fedorchak sponsored the companion resolution in the U.S. House of Representatives.
